Facts and Background

  • Facts and Background:Plaintiff was a 52-year-old accountant, who was diagnosed with a pituitary tumor pressing on optic nerves in late 2022. After one appointment with Dr. Kureshi she was referred for surgery.Plaintiff was in the hospital for about three weeks and inpatient rehabilitation for about a month. She made a significant, but incomplete recovery. Her permanent injuries include a brain injury with diminished cognitive function and hemiparesis of her right side.
  • On January 26, 2023, plaintiff underwent a transsphenoidal pituitary tumor removal surgery that resulted in an injury to a medialized portion of the left internal carotid artery, causing a significant stroke.
  • Plaintiff's Contentions:That Dr. Kureshi negligently performed the surgery and failed to obtain informed consent.
  • Plaintiff further contended that she could no longer function as an accountant and required substantial future medical care.
  • Defendant's Contentions:That Dr. Kureshi was not negligent and had obtained the proper informed consent. Dr. Kureshi also contended that plaintiff was able to work and that any future medical care required was minimal.
