    On the morning of September 30, 2020, plaintiff Dean Marsh was driving his motorcycle westbound in the number one lane on Avenue S in the City of Palmdale. At the same time, defendant was also driving westbound in the number two lane on Avenue S, ahead of plaintiff’s motorcycle, when he made an unsafe lane change while attempting to make a U-turn. He turned his Ford F-350 truck directly into plaintiff’s path.

    Plaintiff’s motorcycle broadsided defendant’s truck, catapulting plaintiff over the handlebars of his motorcycle and onto the pavement, breaking both of his arms. Emergency personnel arrived and transferred plaintiff to the Antelope Valley Hospital, where he would remain for four days to receive treatment for his injuries.

  • Plaintiff's Contentions:

    Plaintiff suffered broken arms and dislocated elbow joints. His arm injuries led to "frozen shoulder" and he had surgeries on both shoulders four months after the crash. He was off work for 10 months, after which he returned to work as a machine-shop engineer. Though his fractures healed, plaintiff continued to experience arm and shoulder pain after the crash.

    Plaintiff had severe arm injuries, but had a full recovery and got back to work and life, travelling extensively and enjoying an active and full life.
