Facts and Background

  • Facts and Background:

Plaintiff is a 76-year-old tenant living in a rent-stabilized apartment in the City of Los Angeles. Defendants Tzvika Diner and OMYOMY, LLC purchased the property in 2020 and notified plaintiff that they wanted her to move so that they could develop the property.

  • Plaintiff's Contentions:

That instead of proceeding under any lawful eviction efforts, defendants engaged in a campaign of harassment to coerce plaintiff to vacate her home. Ms. Langdon proceeded to trial on two causes of action, violations of the Los Angeles Tenant Anti-Harassment Ordinance and violation of the Los Angeles Tenant Buyout Notification Program.

Plaintiff presented evidence that defendant Diner was harassing her into vacating her home and that she was terrified and upset, rather than negotiating for her best interest.

  • Defendant's Contentions:

At trial, the defense claimed that rather than harassing Ms. Langdon, they were just "negotiating" with her to buy out her tenancy.
